Deacs in Love Story/Photo Contest Rules
Official Rules and Regulations
NO PURCHASE REQUIRED TO ENTER OR WIN.
ELIGIBILITY: The “Wake Forest University Deacs in Love Story/Photo Contest” (the “Contest”) is open only to individuals who are students, alumni, faculty, staff and/or friend of Wake Forest University and eighteen (18) years or older at the time of entry. The contest is not open to submissions from professional photographers who submit on behalf of clients or other subjects. The Contest is subject to all federal, state, and local laws and regulations and is void where prohibited by law.
SPONSOR: The Contest is sponsored by the Wake Forest University Office of Alumni Engagement (“Sponsor”), P.O. Box 7227 Winston-Salem, NC 27106 and any other entity involved in the development, administration, promotion, or implementation of the contest (collectively, the “Sponsor”).
AGREEMENT TO OFFICIAL RULES: Participation in the Contest constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth in these Official Rules in a timely manner.
ENTRY PERIOD: The 2023 Contest ends at 11:59 p.m. ET on February 15, 2023 (the “Entry Period”). Entries received outside of the Entry Period will be disqualified. There is not a limit to the number of photos that can be entered.
ENTRY: Post photo(s) and share your storie(s) that highlight(s) the spirit of Wake Forest and celebrate(s) Deacs in Love.
DRAWINGS; ODDS: A panel of judges will convene after the entry period to select up to ten (10) finalists, 4-5 from each category. The categories will be: alumni who graduated in 1995 or later, and alumni who graduated in 1994 and earlier. Photos will be judged on creativity, originality, and accompanying story. The panel’s decisions are final. Sponsor will attempt to notify the finalists via a direct message within two (2) days of the end of the entry period. Finalist photos will be posted on the @WFUAlumni Instagram accounts. Voting will open to the Wake Forest community February 20 –February 23. Votes will be tallied by the total number of “likes” each photo receives. Only individuals with an Instagram account will be able to cast a vote. Voting ends February 23 at noon. For each category, the photo that receives the most cumulative “likes” will be deemed the winner.
PRIZE:
a) The winners receive a “Deacs in Love” gift basket.
The prize will be awarded to the winning stories/photos as determined by voting on social media. The winner will be notified via a social media direct message. The winner must then respond with their name, home address and email address. The Sponsor will then mail the prize to the winner. All applicable taxes associated with any prize are solely the winner’s responsibility. No prize substitutions or transfers permitted, except in Sponsor’s sole discretion. If a potential winner is an eligible minor in his/her state of jurisdiction, any prize will be awarded to his/her parent or legal guardian. An entrant may only win one (1) prize throughout the Contest. Additionally, the winner’s social media username and photo will be declared on the website wfu.edu and announced on official Wake Forest University social media accounts.
PUBLICITY: Participation in the Contest constitutes each winner’s consent to Sponsor’s use of winner’s name, likeness, voice, opinions, biographical information and state of residence for promotional purposes in any media without notice, further payment or consideration.
PRIVACY/TERMS OF USE: All information submitted to Sponsor as part of this Contest will be treated in accordance with all applicable laws and regulations. Participation in the Contests constitutes each participant’s consent to Sponsor’s use of his or her name, likeness, voice, opinions, biographical information, and/or state of residence for promotional purposes in any media without further notice, further payment or consideration.
GENERAL CONDITIONS: In the event that any fraud, virus, technical error, bug, unauthorized human intervention or other problem impairs the administration, fairness, integrity, or security of the Contest, Sponsor may, in its sole discretion, suspend the Contest to address the impairment and either: (a) take reasonable action to resume the Contest in a manner that most closely adheres to the spirit of these Official Rules; or (b) cancel the Contest and award any remaining prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest, or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any provision of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to the identity of any winner based on an Instagram account, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Contest, entrants agree to release and hold harmless Sponsor, Wake Forest University, their officers, directors, employees, and agents (the “Released Parties”) from and against any loss, claim, cause of action or liability arising out of participation in the Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing or human errors; (d) errors in the administration of the Contest or the processing of entries; (e) any incorrect or inaccurate entry information; (f) inability to access the Sponsor’s website; (g) transactions that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any website; or (h) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest, receipt, or use/misuse of any prize.
DISPUTES: Except where prohibited, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of North Carolina; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering a Contest, but in no event attorneys’ fees or expenses; and (c) entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of North Carolina, without giving effect to any choice of law or conflict of law rules (whether of the State of North Carolina or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of North Carolina.
CONTEST RESULTS: For winners’ names, available after February 24, 2023, send a separate, self-addressed, stamped envelope to Wake Forest University Deacs in Love Photo Contest c/o Alumni Office, P.O. Box 7227, Winston-Salem, NC 27109. Requests must be received by March 5, 2023. Winners will also be posted on the wfu.edu website.
